Investigations are underway into the operations of eight companies due to concerns surrounding their pricing strategies on the internet. Additionally, warnings are set to be issued to about 100 more businesses. The companies under scrutiny include StubHub, Viagogo, AA Driving School, BSM Driving School, Gold’s Gym, Wayfair, Appliances Direct, and Marks Electrical.
The Competition and Markets Authority (CMA) is focusing its investigations on how fees are displayed online, potential misrepresentation of limited-time offers, and the automatic inclusion of optional charges without customer consent. In particular, StubHub and Viagogo are being examined for additional charges related to ticket purchases. AA Driving School and BSM Driving School are under investigation for the transparency of fee disclosure on their websites.
Gold’s Gym is being investigated for the presentation of a one-time joining fee for annual memberships, specifically for introducing it midway through the sign-up process. Wayfair is being scrutinized for time-limited sales, Marks Electrical for default opt-ins, and Appliances Direct for the utilization of time-limited sales and default opt-ins.
The CMA clarified that these companies are being investigated under suspicion of violating consumer laws, emphasizing that no final decisions have been made yet. These cases mark the initial enforcement actions under the CMA’s enhanced consumer protection authority. The CMA is also reaching out to 100 other businesses to address concerns regarding additional fees and sales tactics.
In a statement, CMA chief executive Sarah Cardell stressed the importance of ensuring transparent pricing and fair sales practices for online consumers. Cardell emphasized the watchdog’s commitment to cracking down on misleading pricing and unlawful sales tactics to safeguard consumer interests.
Representatives from AA Driving School and Viagogo have expressed willingness to cooperate with the investigations. The Mirror has reached out to Gold’s Gym, Wayfair, Marks Electrical, and Appliances Direct for comments. It is noted that BSM Driving School is a subsidiary of the AA, while Viagogo and StubHub share the same parent company.
