A mother in her twenties, who suffered severe injuries at work when her scalp and ear were torn off in a traumatic incident, has recently received a substantial financial settlement. Anna Rachfal sustained life-altering harm when her hair got entangled in a rotating drill she was operating, leading to the catastrophic loss of her scalp and right ear within moments, causing her to lose consciousness.
Following an investigation by the Health and Safety Executive, P&D Engineering Ltd in Coventry was fined £62,000 for failing to install a necessary guard on the drill, a safety measure the company had acknowledged in its own risk evaluation but opted to disregard.
Subsequently, Anna underwent multiple surgeries, totaling 14 procedures, with some injuries proving irreversible. Upset by the company’s perceived inadequate penalty, she pursued legal action through specialized personal injury solicitors at Osbornes Law. Anna, now 29 years old and a mother of two young children, disclosed her ongoing struggles with post-traumatic stress disorder (PTSD), anxiety, and depression, in addition to physical challenges such as hearing loss, dizziness, and severe nerve pain.
Expressing her sentiments to the Mirror, Anna shared, “The accident had a profound impact on me, altering my appearance and causing me immense physical and emotional suffering. The lack of accountability from my employer was deeply disheartening, as I continue to grapple with the aftermath of the incident.”
Although P&D Engineering Ltd admitted fault for inadequately safeguarding its employees, their insurers only recently settled the case before a scheduled High Court trial to determine the compensation amount. Anna, residing in Coventry with her husband and children, recounted the distressing scrutiny and doubt imposed on her by the defendant’s insurers to validate her injuries, causing additional emotional strain.
Ben Posford, the head of the catastrophic injury team at Osbornes Law, condemned the company’s negligence, emphasizing the importance of stringent health and safety protocols to prevent such tragedies. He applauded Anna’s resilience and bravery throughout the legal process, ensuring she receives the necessary support for her ongoing care and well-being.
Looking ahead, Anna aspires to leverage her experience to advocate for others impacted by life-altering injuries, urging individuals to advocate for their safety and encouraging employers to prioritize employee welfare. She aims to provide hope and inspiration by demonstrating resilience in the face of adversity, emphasizing the strength and courage found in overcoming challenges.
The case underscores the critical need for employers to prioritize health and safety measures, underscoring the consequences of neglecting workplace safety protocols. Ultimately, justice has been achieved for Anna, enabling her to access the essential care and assistance required for her continued recovery and future well-being.
